SCHEELS Website Terms of Use

Effective Date: May 5th, 2026

Welcome to scheels.com and any related websites, mobile applications, digital services and online features operated by Scheels All Sports, Inc. (“SCHEELS,” “we,” “us,” or “our”) (collectively, the “Site”).

These Terms of Use (“Terms”) govern your access to and use of the Site, including any purchases made through the Site and participation in any interactive features such as product reviews, community tools and user-generated content (collectively, “Services”).

By accessing or using the Site, creating an account or making a purchase, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility and Site Use. The Site is intended for individuals who are at least the age of majority in their jurisdiction. By using the Site, you represent that you meet this requirement and have the legal capacity to enter into a binding agreement. The Site is not directed to children under 13.

Certain products or Services may be subject to additional age requirements or legal restrictions. You are responsible for complying with all applicable federal, state and local laws relating to your purchase, possession, or use of any products obtained through the Site.

2. Changes to These Terms. We may update these Terms from time to time to reflect changes in our practices, technology or legal requirements. Updates are effective when posted. Your continued use of the Site after updated Terms are posted constitutes your acceptance of the updated Terms.

3. Accounts and Security. Some features of the Site may require you to create an account. You agree to provide accurate and complete information and to keep your login credentials secure. You are responsible for all activity that occurs under your account.

If you believe your account has been used without authorization, you must notify us promptly.

We reserve the right to suspend or terminate accounts, refuse service or cancel orders at our discretion where we reasonably believe there has been fraud, misuse, violation of these Terms, security concerns or other legitimate business or legal reasons.

4. Product Information and Availability. We strive for accuracy but do not guarantee that product descriptions, pricing, availability, images or specifications are error-free. The product colors you see may vary depending on your monitor and display settings and we cannot guarantee your monitor’s display of any color will be accurate.

We reserve the right to correct errors, update information, limit quantities or discontinue products at any time without notice.

5. Orders and Acceptance. Your submission of an order constitutes an offer to purchase products. SCHEELS acknowledgment or confirmation of your order means that your order request has been received. It does not mean that your order has been accepted, shipped or that the price of an item has been confirmed. We reserve the right, in our discretion, to accept or decline any order for any lawful reason, including, but not limited to: pricing or description errors; inventory limitations; suspected fraud or unauthorized transactions; resale or commercial purchasing activity; or regulatory restrictions. If we cancel an order after your payment has been processed, we will issue a refund to the original payment method.

6. Restricted Products & Legal Compliance. Certain products offered through the Site, including firearms, ammunition and other regulated items, are subject to federal, state and local laws. SCHEELS does not make any representation regarding the legality of any product in your jurisdiction. By purchasing or attempting to purchase restricted products, you represent and warrant that you are legally eligible to do so and that you will comply with all applicable laws and regulations. Product availability may vary by location, and some items may not be available for shipment to certain jurisdictions. SCHEELS reserves the right to refuse or cancel any order involving regulated products where required by law or where we determine, in our discretion, that a transaction may pose legal or safety risks.

7. Prohibited Purchasing Practices. To protect customers and ensure fair product access, we may limit or cancel orders or restrict accounts where we determine, in our reasonable discretion, that purchasing activity involves automated tools, bots, bulk purchasing inconsistent with personal use, resale activity or fraudulent conduct. Where permitted by law, we may impose reasonable administrative or service fees associated with such activity, provided any required disclosures are made prior to assessment of such fee.

8. Returns & Policies. Returns, exchanges, shipping, promotions and other transactional matters may be governed by additional posted policies, including our Return Policy and Shipping Policy. Those policies are incorporated into these Terms by this reference.

9. User Content & Reviews. You may submit reviews, comments, photos or other content (“User Content”). By submitting User Content, you grant SCHEELS a non-exclusive, perpetual, irrevocable, royalty-free, worldwide, sublicensable license to use, reproduce, modify, display, publish, distribute and create derivative works from the User Content in connection with our business, marketing, promotional and educational activities without further notice or compensation to you. You represent and warrant that you own or otherwise have the necessary rights to submit the User Content and that your content does not violate any law or infringe on the rights of any third-party. SCHEELS may, in its sole discretion, use, remove, modify or otherwise manage User Content, and is under no obligation to monitor, approve or take action with respect to any submissions. Your content reflects your views and experiences only and does not represent the views of SCHEELS.

10. Prohibited Conduct. You agree not to misuse the Site or Services. This includes engaging in unlawful activity, attempting unauthorized access to systems, interfering with Site functionality, using automated bots or other data collection tools or submitting harmful, infringing or deceptive content.

11. Intellectual Property. All content on the Site, including trademarks, text, graphics, logos, images and software is owned by SCHEELS or its licensors and protected by intellectual property laws. You may use the Site only for personal, non-commercial purposes. No rights are granted except as expressly stated in these Terms.

12. Third-Party Links and Services. The Site may contain links to third-party websites or services. SCHEELS is not responsible for the content, policies or practices of third parties.

13. Privacy. Our collection and use of personal information is governed by our Privacy Policy. In the event of a conflict between these Terms and the Privacy Policy regarding personal data practices, the Privacy Policy controls.

14. Accessibility. We strive to make our digital experiences accessible to all users. If you experience difficulty accessing any part of the Site, please contact customer service for assistance.

15. Disclaimer of Warranties. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, SERVICES, AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

16. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCHEELS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF: (1) THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM OR (2) $100.

17. Indemnification. You agree to indemnify, defend, and hold harmless SCHEELS and its affiliates, officers, directors, employees and agents from any claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs or expenses, including reasonable attorneys’ fees, arising out of or related to: your use of the Site or Services; your violation of these Terms or any applicable law or regulation; your User Content, including any allegation that such content infringes or violates the rights of a third party; your purchase, possession, use, misuse or inability to use any products obtained from SCHEELS, whether purchased through the Site or in-store, including any personal injury, death or property damage arising from such products, except to the extent caused by SCHEELS’ gross negligence or willful misconduct; your failure to follow product instructions, warnings or applicable safety precautions; your violation of any laws relating to the purchase, ownership, transfer, storage or use of regulated or restricted products; or any negligent, reckless or intentional acts or omissions by you or any person to whom you provide a product purchased from SCHEELS.

SCHEELS reserves the right, at its expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate fully with SCHEELS in asserting any available defenses.

Your indemnification obligations will survive termination of these Terms and your use of the Site or products.

18. Mobile Messaging Terms of Service. The Scheels mobile message service (the “Service”) is operated by SCHEELS. Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Scheels’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Scheels through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Scheels. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +85147 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Scheels mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number should you desire to continue involvement in the Service.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and any action you may or may not take in reliance on the information or Service.

19. Disputes, Arbitration and Class Action Waiver.

Except for matters eligible for small claims court, any dispute, claim or controversy arising out of or relating to these Terms, the Site or products purchased from SCHEELS shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. Arbitration may be conducted by telephone, video, written submissions, or in person as permitted by AAA rules.

You agree that disputes will be conducted on an individual basis only. Class, collective or representative actions are not permitted.

The Federal Arbitration Act governs this section. Except as otherwise required by law, North Dakota law governs these Terms without regard to conflict-of-law principles.

20. Severability. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and the remaining provisions shall remain in full force and effect. SCHEELS’ failure to enforce any provision shall not constitute a waiver of that provision.
